DOT Drug and Alcohol Testing Policy
Policy Contents
Purpose
Colby Community College is committed to the health, safety, and welfare of our employees and students. This policy is designed to prevent accidents and injuries resulting from alcohol misuse and controlled substance use by employees performing safety-sensitive functions.
Applicability
This policy applies to all employees of Colby Community College who:
- Hold a Commercial Driver’s License (CDL);
- Operate a Commercial Motor Vehicle (CMV); or
- Perform safety-sensitive functions.
This includes part-time, full-time, and temporary employees.
Safety-Sensitive Functions
Safety-sensitive functions include:
- Driving a CMV;
- Waiting to be dispatched;
- Inspecting or servicing a CMV; and
- Loading or unloading a CMV.
Prohibited Conduct
The following conduct is prohibited for any driver covered by this policy:
- No driver shall report to duty or remain on duty requiring the performance of safety-sensitive functions while having an alcohol concentration of 0.04 or greater.
- No driver shall possess or use alcohol while on duty or while performing safety-sensitive functions.
- No driver shall perform safety-sensitive functions within four hours after using alcohol.
- No driver required to take a post-accident alcohol test shall use alcohol for eight hours following the accident, or until tested, whichever occurs first.
- No driver shall refuse to submit to any test required under 49 CFR Part 382, including pre-employment, post-accident, random, reasonable suspicion, return-to-duty, or follow-up testing.
- No driver shall report for duty or remain on duty requiring safety-sensitive functions when using any controlled substance, except when the use is pursuant to the instructions of a licensed medical practitioner who has advised the driver that the substance will not adversely affect the driver’s ability to safely operate a commercial motor vehicle.
- No driver shall report for duty, remain on duty, or perform safety-sensitive functions if the driver tests positive for controlled substances.
- A driver with an alcohol concentration of 0.02 or greater but less than 0.04 shall be removed from safety-sensitive functions for at least 24 hours.
Required Testing
The College shall conduct the following DOT-required testing programs:
- Pre-employment testing
- A verified negative drug test must be received before performing any duties for the College.
- Random testing
- All CDL drivers must be in a random testing pool at all times, with minimum annual testing rates of 50% for drugs and 10% for alcohol. Random testing must be unannounced and spread throughout the year.
- Post-accident testing
- All drivers who are issued a citation, which includes either a reported injury or vehicle damage, or any accident that includes a fatality, are required to submit to post-accident testing for alcohol within eight hours of the accident and drugs within 32 hours of the accident.
- Reasonable suspicion testing
- All drivers must submit to reasonable suspicion testing, which will be based on observable behavior, speech, or appearance. All supervisory personnel will be trained on reasonable suspicion testing.
- Return-to-duty testing
- All drivers who are involved in a violation must have a negative test before returning.
- Follow-up testing
- Follow-up testing will occur when a driver returns to duty and will include at least six tests in the first 12 months of return.
Drug and Alcohol Clearinghouse
The College will participate and register as an employer in the DOT Drug and Alcohol Clearinghouse.
The College shall:
- Conduct pre-employment queries;
- Conduct required annual queries; and
- Prohibit drivers with unresolved violations from driving.
Refusals to Test
Refusal to test includes:
- Failing to appear at the test;
- Failing to provide a specimen;
- Tampering with or adulterating the specimen; and
- Leaving the testing site early.
Refusals to test will be treated as a positive test result, which could result in discipline up to and including termination.
Supervisory Training
All supervisory staff must complete one-time training on the following topics:
- 60 minutes of training on alcohol misuse; and
- 60 minutes of training on controlled substance use.
Record Keeping
The College will retain all required recordkeeping and documentation required to administer this policy.
Acknowledgement
All employees subject to this policy must acknowledge it annually.
